Terms of service

These terms govern the ordering and use of the digital reputation reports ("Reports") that Science 4 Insights, S.L. ("ValuesCheck", "we") provides to companies and organisations (the "Client"). The services are intended exclusively for businesses and professionals; they are not provided to consumers.

1. Description of the service

ValuesCheck prepares Reports on the digital reputation of people with a public profile (content creators, public figures, candidates, artists) from publicly accessible information: press and open sources, and the person's own public posts on social networks, together with a sample of the comments they receive. The Report is delivered on a private platform and as PDF, in two formats: executive brief and full report.

The research is carried out by artificial-intelligence systems under ValuesCheck's own model. When the supervised option is ordered, a reputation expert reviews the Report and adds their assessment. The Report includes a reasoned recommendation; the recommendation is not binding and the decision rests exclusively with the Client.

2. Ordering

Services are ordered through a proposal accepted in writing (including by email) or through an order placed in the client area. Each order identifies the person to be analysed, the market, the period and, where applicable, the brands and the type of collaboration. The Client warrants that the information provided is accurate and that the person identified is the one it intends to assess.

3. Purpose and lawful use

The Client represents and warrants that it requests each Report with a legitimate interest, to make pre-contractual or selection decisions (commercial collaborations, sponsorships, candidacies or equivalent decisions), and that it will comply with applicable law, including data protection and any employment or electoral rules that apply.

The Client undertakes not to use the Reports to:

• publish, disseminate or communicate them, in whole or in part, to third parties outside the decision, or in media, social networks or commercial communications;
• harass, intimidate, discredit or harm the person analysed, or for purposes other than the decision for which they were requested;
• make decisions based on protected characteristics (origin, beliefs, sexual orientation, health, union or political affiliation, among others) where the law prohibits it;
• resell, assign or incorporate them into its own or third-party products or services.

The Client is liable to ValuesCheck and to third parties for any use of the Reports contrary to these terms.

4. Nature of the Reports and limitations

Reports compile public information available on the date stated in each one, classified by the degree of certainty the sources allow: verified, third-party opinion or reported without confirmation. ValuesCheck applies a rigorous method but does not guarantee that public information is true, that all existing information has been found, or that findings remain current after the Report date. The absence of findings does not establish the absence of risk.

Reports are information tools and do not constitute legal, financial, employment or other advice, nor a statement by ValuesCheck about the guilt, liability or conduct of the person analysed. Cited sources are responsible for their own content.

5. Prices, invoicing and payment

Prices are set in each proposal, per Report and by volume, and exclude taxes. Unless otherwise agreed, Reports delivered are invoiced monthly, payable within 15 days by bank transfer. ValuesCheck may suspend the service in the event of non-payment. Reports already started are not refundable; Reports that cannot be completed for reasons attributable to ValuesCheck are not invoiced.

6. Delivery and platform

Reports are delivered in the client area, accessed with credentials, and can be downloaded as PDF. Usual turnaround is the same business day for standard Reports and one additional business day for supervised Reports; these are estimates, not essential deadlines. ValuesCheck keeps Reports on the platform for 12 months from delivery; the Client should download what it needs to keep.

7. Confidentiality

ValuesCheck treats the Client's identity, orders and Reports as confidential and does not disclose them to third parties except under a legal obligation or a request from a competent authority. The Client treats the content of the Reports and ValuesCheck's method as confidential and limits access to the people involved in the decision.

8. Intellectual property

The Client acquires a non-exclusive, non-transferable right of internal use over each paid Report, for the purpose described in these terms. ValuesCheck's method, models, classifications, templates and software are the exclusive property of Science 4 Insights, S.L. and are not assigned. Reproducing the format or structure of the Reports to create competing products is not permitted.

9. Data protection

In preparing Reports, ValuesCheck acts as controller of the data of the people analysed, in accordance with its Privacy policy. The Client is the controller of the processing it carries out with the Report received and is responsible for its own obligations, including informing the person where the law requires it. Each party is responsible for its own processing.

10. Liability

To the fullest extent permitted by law, ValuesCheck's total liability to the Client for any cause related to a Report is limited to the amount paid for that Report. ValuesCheck is not liable for loss of profit, loss of business or indirect damages, for decisions the Client makes on the basis of the Reports, or for the consequences of any use of the Reports contrary to these terms.

11. Suspension and termination

ValuesCheck may suspend or cancel the Client's access if it breaches these terms, uses the Reports unlawfully or in a way that harms third parties, or fails to pay. Either party may end the relationship with 30 days' notice, without prejudice to Reports already ordered.

12. Changes

ValuesCheck may update these terms. Changes are published on the Site and notified to Clients with orders in progress 30 days in advance. Orders are governed by the terms in force on the order date.

13. Governing law and jurisdiction

These terms are governed by Spanish law. The parties submit to the Courts of the city of Barcelona and waive any other jurisdiction to which they may be entitled.
